Agreement for Use of this Website This agreement constitutes an Amendment to the Provider Agreement between Provider and Partnership HealthPlan of California (PHC). By pressing the button marked I accept, Provider is agreeing to this amendment to his/her/its Provider Agreement. Providers Responsibility when using this Website. Provider responsibility. Provider is responsible for managing access to Provider data. Usernames and passwords are associated with Providers and tracked by the system. 1. Agreement to confidentiality of usernames and passwords. Usernames and passwords are not to be shared with others since they provide access to identifiable personal health information protected by California privacy laws and regulations and by HIPAA legislation and regulations. Violations of these laws and regulations are punishable by substantial fines and other penalties. 2. Agreement to use best efforts to protect privacy. By accepting these terms and proceeding to use electronic eligibility or other online PHC services, Provider agrees that Provider will use his/her/its best efforts to protect the privacy of personally identifiable health information and the username(s), password(s), and secret key provided by PHC or by this application. 3. Agreement to inform PHC of employee departures. Provider agrees that if an employee (including another Provider) leaves the Providers office, the Provider will so inform PHC so that that persons username and password can be retired and PHC can issue the Provider a new secret key. Information About Privacy, Security, Accuracy and Liability Privacy of data. PHC will protect personal health information in its systems. PHC will not knowingly issue usernames or passwords to any individual not authorized by the responsible Provider nor will PHC share medical data except for the purposes of patient care or compliance with laws and regulations. PHC will not sell or share personally identifiable health information or demographics with any third parties. How PHC protects data. PHC uses Secure Sockets Layer (SSL) 3.0 as the encryption method for securing communication of content to and from Providers over the web. This tool is used by many online Internet businesses including banks, stock brokerages, book vendors, airlines, and the like. PHC has also implemented the Public key cryptography (commonly called PKI) system on our website for added security using Thawtes (Certificate Authority) digital certificates. This provides 50 bit data encryption for the secure channel. Username and password for the secure website. We provide username and password protection for the Provider only pages of the website. On these pages Providers can check member eligibility and eventually use other online facilities we will offer. Username and passwords act as the gatekeeper to protect the system from unauthorized intruders. Username registration is automated with two levels of security. They are as follows: Secret key mechanism. 1. PHC will provide a username and password for every individual in a Providers office. 2. PHC will supply each Provider office one secret key for registration of usernames. 3. If there are multiple people who work in a Provider office, all will use the same secret key to register for a username and password on the PHC website. 4. Each Provider agrees that he/she is responsible use of the secret key within that Provider office and agrees that PHC will not be responsible or liable for the loss or misuse of that Providers secret key or any related issues. 5. If an employee leaves the Providers office, the Provider agrees to inform PHC so that that persons username and password can be retired, and PHC will issue the Provider a new secret key. Accuracy. PHC warrants that it has used reasonable care in developing this software and the database upon which it operates and that it has tested the system and data extensively. Notwithstanding this care, Provider understands that there may be errors in either the program or data and holds PHC harmless for such errors. Copyright.
